قضت الدائرة الأولى بمحكمة القضاء الإدارى بمجلس الدولة، برئاسة المستشار يحيى دكرورى، نائب رئيس مجلس الدولة، بعدم قبول الدعوى المقامة من سمير سبوسه غبريال، والتى تطالب بإلغاء قرار شيخ الأزهر بإشهار إسلام نجلته مريم، لرفعها من غير ذى صفة.
وذكرت الدعوى التى حملت رقم 6347 لسنة 65 ق، إن نجلة المدعى "مريم" اختفت من المنزل، وحرر محضر بذلك فى المراغة بسوهاج، إلا أنه فوجئ بأن الأزهر أشهر إسلامها على الرغم من إنها معاقة ذهنياً.
وقالت المحكمة فى حيثيات حكمها، إن المحامى الذى أقام الدعوى لم يودع سند الوكالة عن المدعى، وهو ما يتعين معه القضاء بعدم قبول الدعوى لرفعها من غير ذى صفه.
